The Committee on the Judiciary
moves to amend the title of the
bill as follows:
H. B. 4100 -- "
A Bill to repeal §28-5-2, §28-5-10, §28-5-11,
§28-5-12, §28-5-13, §28-5-14, §28-5-15, §28-5-16, §28-5-17,
§28-5-18, §28-5-19, §28-5-20 and §28-5-21 of the Code of West
Virginia, 1931, as amended, relating to outdated provisions
addressing the operation of the penitentiary by the Commissioner of
Public Institutions; allowing the warden to hire out inmates as
domestics
; allowing the Commissioner to advertise and hire out
inmate labor by contract
; establishment of bid and rate
specifications for inmate labor
; establishment of bond requirements
for labor bids; establishment of opening and acceptance standards
for inmate labor bids
; establishment of the general requirements
of inmate labor contract and provisions for modifying or
terminating that contract; termination date of inmate labor
contracts made by the same party; sixty day limit to procure
machinery and make preparations necessary for the labor contract
;
two months notice of default, forfeiture of bond, termination of
contact, and liability for damages; state to furnish steam power
necessary for contract machinery
; convicts limited to nine hour
work day; and billing procedures for inmate labor
."
